MOBILE PRIVACY POLICY – ANDROID PLEASE READ THIS IMAPORTER MOBILE ACCESS APPLICATIONS PRIVACY POLICY WHICH IS PART OF THE IMAPORTER MOBILE ACCESS APPLICATIONS END USER LICENSE AGREEMENT (“EULA”) CAREFULLY. ANY TERMS DEFINED IN THE EULA SHALL HAVE THE SAME MEANING IN THIS PRIVACY POLICY. THIS PRIVACY POLICY PERTAINS TO YOUR ACCESSING AND USING IMAPORTER MOBILE ACCESS SERVICES VIA THE IMAPORTER MOBILE ACCESS APPLICATIONS WHICH YOU DOWNLOADED THROUGH THE GOOGLE PLAY MARKETPLACE FOR USE WITH A MOBILE DEVICE RUNNING ANDROID SOFTWARE (“IMAPORTER MOBILE ACCESS APPLICATIONS”). This policy describes the information collected during registration for and directly through the IMAporter Mobile Access Applications. If you would like information about how IMA collects, uses, shares, and protects information about you outside of the IMAporter Mobile Access Applications, please read the IMA Privacy Policy. The IMAporter Mobile Access Applications connects you to the IMA website where you can use the Services (as defined in the IMA Privacy Policy). ATTENTION: PLEASE READ OUR PRIVACY POLICY CAREFULLY BEFORE DOWNLOADING THE IMAPORTER MOBILE ACCESS APPLICATIONS. DOWNLOADING OR USING THE IMAPORTER MOBILE ACCESS APPLICATIONS INDICATES THAT YOU ACCEPT AND AGREE TO BE BOUND BY THIS PRIVACY POLICY IN FULL. We reserve the right to modify or discontinue the IMAporter Mobile Access Applications (or any portion of the IMAporter Mobile Access Applications), temporarily or permanently, with or without notice to you, and are not obligated to support or update the IMAporter Mobile Access Applications. You agree that IMA shall not be liable to you or any third party in the event that we exercise our right to modify or discontinue the IMAporter Mobile Access Applications (or any portion of the IMAporter Mobile Access Applications). Unless explicitly stated otherwise, any new features that augment or enhance the current IMAporter Mobile Access Applications shall be subject to this Privacy Policy. This Privacy Policy was last revised on August 09, 2018. We may change or add to this Privacy Policy, so we encourage you to review it periodically. If we materially change this Privacy Policy, we’ll let you know by showing it to you again when you open the IMAporter Mobile Access Applications. Customer Data/User Data IMA customers may electronically submit data or information about fundraising prospects and donors to the Services for hosting and processing purposes (“Customer Data”) IMA will not review, share, distribute, or reference any such Customer Data except as provided in the Master Subscription Agreement, or as may be required by law. IMA may access Customer Data in accordance with the Master Subscription Agreement. Personal information about or generated by users of IMA’s website and Services (“User Data”) is not Customer Data. I. Data We May Collect  We collect the following types of User Data in the manner described below. You may voluntarily provide us with information: * Your name, email address, phone number, ID and password * Information needed to provide the Wi-Fi connection; * Information needed to provide the Bluetooth connection; * Information needed to provide NFC connection * Technical information related to your device including operating system and application software * Limited aggregate data may be available to IMA upon its written request to Google. We automatically collect other information about you and/or about your device, including: * Your IP address; * Your MAC address; * The IMAporter Mobile Access Applications features that you use and the time of your use II. How We Use Your Data We use the User Data that we collect for the following purposes, including: * To process and respond to your inquiries and comments; * To improve and develop our products and services, provide you with software updates and support, manage our websites; * To personalize and enhance your experience using the IMAporter Mobile Access Applications; * To contact you with information regarding our services * To prevent fraud and abuse of the IMAporter Mobile Access Applications and to otherwise protect our customers, us or others * To assist law enforcement Other uses of the User Data or Customer Data may be permitted under the IMA Services Agreement or IMA Services EULA. III. How User Data is Disclosed  User Data may be disclosed to third parties in accordance with our website Privacy Policy. Please note that a user may choose not to share certain information as described in Your Choices Regarding Your Information below. A. Third Party Service Providers and Business Partners. We may use third party service providers and trusted business partners to perform functions in connection with the IMAporter Mobile Access Applications. Examples include functions related to analyzing and improving the IMAporter Mobile Access Applications usefulness, storing data, providing users with products and services, administrative functions such as back up and security, and as otherwise described in this Privacy Policy. Additionally, for the improvement of Google Play, Google may collect certain information from Google Play and your mobile device, including but not limited to, information on how Google Play and your mobile device are being used. According to Google, the data collected is examined in the aggregate to improve Google Play for users and developers and is maintained in accordance with Google’s Privacy Policy. We neither can control nor are responsible for the privacy practices of Google. B. Customer. We disclose User Data about your use of the IMAporter Mobile Access Applications to the IMA customer with which you are employed, affiliated or associated (“Customer”). C. Business Changes. If we become involved in a merger, acquisition, sale of assets, bankruptcy, reorganization, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, we may transfer your User Data to a third party or parties in connection therewith. D. Investigations and Law. We reserve the right to investigate fraud and abuse on the IMAporter Mobile Access Applications and its Services. We may disclose User Data to third parties if we have a good faith belief that such disclosure is reasonably necessary to: * Take action regarding suspected illegal activities; * Enforce or apply this Privacy Policy or other agreements with us; * Comply with the law or guidance and cooperate with government or law enforcement officials or private parties; * Protect our rights, reputation, safety, and property, or that of users or others; * Respond to claims and legal process (for example, subpoenas); and/or * Protect against legal liability. Aggregated Information. We may share aggregated User Data with affiliated or unaffiliated third parties. Security While we take reasonable measures to protect the User Data you submit via the IMAporter Mobile Access Applications against loss, theft and unauthorized use, disclosure, or modification, we cannot guarantee its absolute security. No Internet or app transmission is ever fully secure or error free. You should use caution whenever submitting User Data through an application and take special care in deciding with which information you provide us. IV. Data Retention Policy, Managing Your Information We will retain your User Data for as long as you use the IMAporter Mobile Access Applications and for a reasonable time thereafter. Please note that some or all of the User Data we have collected may be required in order for the IMAporter Mobile Access Applications to function properly. V. Links to Other Websites or Applications This Privacy Policy applies only to the IMAporter Mobile Access Applications. The IMAporter Access Mobile Applications may contain links to other websites or apps or may forward users to other websites or apps that we may not own or operate. The policies and procedures we describe here do not apply to these websites or apps. We neither can control nor are responsible for the privacy practices or content of these websites or apps. Your Choices Regarding Your Information You have choices regarding the use of your User Data by the IMAporter Mobile Access Applications. To change your information, including keeping your information accurate, please contact the Customer’s administrator who has access to modify your information. If you no longer want the IMAporter Mobile Access Applications to collect and use information about you: * Uninstall the IMAporter Mobile Access Applications – You can stop all collection of information by the IMAporter Mobile Access Applications by uninstalling the mobile application. You may use the standard uninstall processes available as part of your mobile device or via the mobile application marketplace or network. VII. Children  We do not knowingly collect personal information from an individual under age 13. If you are under the age of 13, please do not submit any personal information through the IMAporter Mobile Access Applications. If you have reason to believe that we may have accidentally received personal information from an individual under age 13, please contact us immediately at privacy@ima.cz VIII. Your EU Privacy Rights  The Article 29 Working Party, composed of representatives from all EU Data Protection Authorities, the EDPS and the European Commission, was set up under the Directive 95/46/EC. It has advisory status and acts independently. Under EU law, personal data can only be gathered legally under strict conditions, for a legitimate purpose. Furthermore, persons or organisations which collect and manage your personal information must protect it from misuse and must respect certain rights of the data owners which are guaranteed by EU law. X. Warranty We do not warrant that the licensed service will meet your requirements, the services will be uninterrupted, without errors, viruses or the like or that the results that may be obtained by using the services will be correct or reliable. We are not reponsible for potential loss of your personal data. By providing us your personal data, you hereby agree to assume all risk of any and all potential damages and loss from use of- or the inability to use the licensed services. XI. Limitation of Liability In no event we shall be liable for damages, losses, liabilities or claims unless otherwise provided by applicable law: a) resulting from incorrect or inaccurate information provided by you b) incurred by you or your property for reasons attributable to you or your failure to fulfill your obligations under this agreement; c) resulting from unauthorized or unauthorized third party access to or use of the equipment, licensed materials or services; and d) resulting from unauthorized interruption or suspension of third-party traffic to a server or server, or illegal or unauthorized access to or use of the server, despite our actions with due care to prevent such access.
